Utah charges predictions platform Kalshi with illegal gambling

Utah prosecutors have filed 14 criminal charges against prediction platform Kalshi and its founders, alleging the company is operating an illegal gambling business within the state. The case follows an undercover investigation and highlights a growing jurisdictional conflict between state gambling regulators and federal financial authorities.
Why it matters
This case represents a critical test of whether prediction markets are federally regulated financial derivatives or state-regulated gambling, a distinction that could determine the future of the entire decentralized betting industry in the U.S.
Prosecutors brought 14 charges against KalshiEX LLC and founders Tarek Mansour and Luana Lopes Lara. These include a felony count for an alleged pattern of unlawful activity, 12 counts for promoting online gambling and one misdemeanor gambling charge.
CoinDesk reached out to Kalshi for comment but did not receive a response by the time of publication.
The case relies on evidence gathered by an undercover agent from the Utah Attorney General’s Office who used a local address, phone number, and debit card to access the platform in September.
Kalshi reportedly allowed the agent to place 12 distinct sports wagers. These transactions, the state claims, prove the platform is actively promoting illegal gambling within its borders.
Kalshi is a federally regulated exchange in the U.S. that lets users place bets on event contracts tied to binary real-world events such as elections, sporting outcomes, economic data releases, and weather patterns.
