Private unaided schools move Karnataka HC on delay in reimbursement of expenditure for RTE quota students

Private unaided schools in Karnataka have petitioned the High Court regarding the state government's failure to update and reimburse 'Per Child Expenditure' under the RTE Act. The schools argue that stagnant reimbursement rates since 2017 are causing significant financial strain.
Why it matters
The case highlights the tension between government mandates for free education and the financial sustainability of private institutions serving disadvantaged students.
The High Court of Karnataka has ordered issue of notice to the State government on a petition seeking fixation of ‘Per Child Expenditure’ (PCE) and reimbursement for the academic year 2026-27 to the unaided private schools towards 25% of the students admitted under the provisions of the Right of Children to Free and Compulsory Education (RTE) Act, 2009.
Also, the court ordered issue of notice to the Central government on the plea for a national protocol for determining the PCE under Section 12(2) of the RTE Act.
Justice H.T. Narendra Prasad passed the order on a petition filed by the Associated Managements of Primary and Secondary Schools in Karnataka, which represents over 4,000 private unaided schools in the State.
