Foreign credit accommodation in Tanzania: the limits of regulatory non

Foreign credit accommodation comprising foreign loans, advances, overdrafts, guarantees and other forms of offshore financing is regulated in Tanzania under the Foreign Exchange Act, Chapter 271 R.E 2023 (the Foreign Exchange Act ) and the Foreign Exchange Regulations, 2022 (as amended) (the Foreign Exchange Regulations ), and supervised by the Bank of Tanzania ( BoT ).
The regulatory framework establishes mandatory procedures governing foreign credit facilities. Compliance with these requirements is crucial to enable the lawful movement of funds across borders and the performance of repayment obligations by Tanzanian borrowers. In practice, however, some foreign credit arrangements have been entered into without strict adherence to the applicable foreign exchange requirements. This raises the important question of whether the regulatory non-compliance relieves the borrower from its obligations to repay the received funds.
