The Centre has opposed a plea before the Delhi High Court seeking a stay on eviction proceedings against the Delhi Gymkhana Club, contending that the court lacks jurisdiction to entertain the application.
In its reply to an interim plea by club member Vijay Khurana, the Centre on Monday said that Section 15 of the Public Premises (Eviction of Unauthorised Occupants) Act creates a “two-fold” bar by excluding civil courts from proceedings relating to eviction from public premises and prohibiting the grant of “any injunction in respect of any action taken or to be taken by the Estate Officer”.
