CLARITY Act Odds Collapse to 37% After Senate Leader Says Crypto Bill Won't Pass Before Recess

The probability of the Digital Asset Market Clarity Act passing in 2026 has dropped significantly after Senate Majority Leader John Thune indicated it would not be addressed before the August recess. Despite White House optimism, the bill currently lacks the necessary bipartisan support to overcome the Senate's 60-vote threshold.
Why it matters
The potential failure of this legislation creates ongoing regulatory uncertainty for the US cryptocurrency industry.
Senate Majority Leader John Thune told reporters Thursday that he does not expect the Digital Asset Market Clarity Act to pass the Senate before Congress departs for its August recess - the deadline that analysts and Wall Street strategists have consistently identified as the last realistic gate for 2026 passage. "I don't think we'll be able to get them done," Thune said when asked about the CLARITY Act and a separate name, image, and likeness bill for college athletics. "I would like to at least get Clarity started. We'll see where the votes are."
