A lawyer representing ECCO Recycling and Energy Corp. disputed the claim, and pointed out it has not yet been proven in court. The company has until Oct. 14 to formally respond to the allegation.
Lawyers for the city and ECCO were in court Thursday. The city is looking to speed up an injunction request to force ECCO to shut down operations at the former landfill site.
A judge recently issued an injunction calling on ECCO to remove waste from its nearby recycling facility site. The injunction does not apply to the landfill, and so the city is seeking a separate injunction to make that happen.
